1. Acceptance of Terms
By creating an account or using the Equipment Balkans platform ("Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Platform. These Terms apply to all visitors, users, sellers, buyers, and others who access or use the Platform.
2. Account Registration
To access certain features of the Platform, you must create an account and provide accurate, complete, and current information. You are responsible for safeguarding your login credentials and for all activities that occur under your account. You must be at least 18 years old to use this Platform. You represent that you have the legal capacity to enter into a binding agreement.
3. Seller Obligations
Sellers on the Platform agree to: - Provide accurate and truthful descriptions of all listed equipment, materials, and services. - Not list prohibited items, including stolen goods, hazardous materials without proper documentation, or items restricted by applicable law. - Respond to buyer inquiries in a timely manner. - Honor auction results and completed transactions. - Comply with all applicable export, import, customs, and trade regulations. Equipment Balkans reserves the right to suspend or terminate seller accounts that violate these obligations.
4. Buyer Obligations
Buyers on the Platform agree to: - Provide accurate payment and contact information. - Honor winning bids in auctions and complete purchase transactions. - Inspect equipment within the agreed inspection period. - Not engage in fraudulent bidding, shill bidding, or any form of market manipulation. Failure to honor a winning bid may result in account suspension and potential liability for damages.
5. Auction Rules
Auctions conducted on the Platform are legally binding: - All bids are final and constitute a binding offer to purchase. - The highest bidder at auction close is obligated to complete the transaction. - Reserve prices, if set, must be met for a sale to occur. - Equipment Balkans acts as an intermediary and is not a party to the underlying sale contract between buyer and seller. Auction terms (duration, increments, reserve price) are set by the seller and displayed before bidding begins.
6. Fees and Payments
Equipment Balkans charges the following fees: - Listing fees: Free for basic listings; premium placement available for a fee. - Auction success fee: A percentage of the final hammer price, payable by the seller upon successful completion. - Buyer premium: May apply to certain auctions as disclosed before bidding. - Payment processing fees: Standard payment processor rates apply. All fees are displayed before you commit to a transaction. Fees are non-refundable unless otherwise stated.
7. Intellectual Property
All content on the Platform, including text, graphics, logos, images, and software, is the property of Equipment Balkans or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Platform content without prior written consent. Content you post (listings, reviews, messages) grants Equipment Balkans a worldwide, non-exclusive license to use, display, and distribute such content for Platform operations.
8. Dispute Resolution
In the event of a dispute arising from Platform use: - Parties should first attempt to resolve the dispute through direct communication. - If unresolved, either party may request mediation through Equipment Balkans' dispute resolution process. - For claims exceeding EUR 10,000, binding arbitration shall be conducted under the rules of the Permanent Court of Arbitration in Belgrade, Serbia. These Terms are governed by the laws of Serbia. Courts in Belgrade, Serbia shall have exclusive jurisdiction over any disputes.
9. Limitation of Liability
Equipment Balkans provides the Platform "as is" and "as available." To the maximum extent permitted by law: - We make no warranties, express or implied, regarding the Platform's accuracy, reliability, or availability. - We are not liable for indirect, incidental, special, consequential, or punitive damages. - Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We are not responsible for the actions of buyers, sellers, or third parties using the Platform.
10. Termination and Modifications
We may modify these Terms at any time. Continued use of the Platform after modifications constitutes acceptance of the updated Terms. We may suspend or terminate accounts that: - Violate these Terms repeatedly or seriously. - Engage in fraudulent or illegal activity. - Have been inactive for more than 24 months. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (intellectual property, liability limitations) will remain in effect.
